Terms of Service

1. Acceptance

By creating an account or using ViraLab AI, you agree to these Terms of Service and our Privacy Policy. If you use the service for a business or another person, you confirm that you have authority to bind them. You must be at least 18 years old.

2. The service

ViraLab AI provides AI-assisted tools for generating ecommerce images and videos, organising outputs, downloading media, purchasing usage credits, and publishing approved content through supported third-party platforms. Features, providers, limits, and model availability may change as the service develops.

3. Accounts and security

You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorised access. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures. You may not share, sell, or transfer access in a way that compromises the service.

4. Your content and permissions

You retain any rights you hold in prompts, product information, reference media, and other material you submit (“User Content”). You grant ViraLab AI and its service providers a limited, worldwide licence to host, copy, transmit, modify, and process User Content only as needed to operate, secure, and improve the requested service.

You confirm that you own or have all required rights and permissions for User Content, including product branding, copyrighted works, trademarks, and images or likenesses of people. Uploading a person’s image does not by itself establish their consent.

5. AI-generated content

AI outputs may be inaccurate, incomplete, visually inconsistent, similar to other outputs, or unsuitable for your intended use. Text, logos, product labels, people, claims, and regulated-product details may be distorted or invented. You must review every output before using or publishing it.

To the extent permitted by law and applicable provider terms, you may use generated outputs for your business. We do not guarantee that an output is unique, non-infringing, registrable, commercially effective, or eligible for intellectual-property protection. You remain responsible for advertising claims, disclosures, licences, approvals, and compliance with laws and platform rules.

6. Acceptable use

You must not use ViraLab AI to create, upload, distribute, or promote:

• illegal, fraudulent, deceptive, defamatory, threatening, or abusive material;
• content that infringes intellectual-property, privacy, publicity, or other rights;
• non-consensual intimate imagery, sexual content involving minors, or exploitation;
• impersonation, misleading synthetic media, scams, or manipulated endorsements;
• malware, attempts to bypass security, automated abuse, scraping, or service disruption;
• content prohibited by an AI provider, payment provider, TikTok, or another connected platform.

We may block inputs or outputs and suspend access where reasonably necessary for safety or compliance.

7. Credits and payments

Generations consume the number of credits shown before submission. Credits are non-transferable, have no cash value, and may be used only within ViraLab AI. When a generation fails before producing a usable output, the service is designed to return the applicable generation credits. Processing delays do not necessarily mean a task failed.

One-time credit packs are processed by Stripe. Prices and included credits are displayed at checkout. Except where required by law or expressly stated, completed purchases are final. Taxes and currency conversion may apply.

8. TikTok and third-party services

TikTok connection and publishing are optional. You must connect an account you are authorised to control and review the destination account, post text, privacy, interaction, and commercial-content settings before confirming publication. You are responsible for complying with TikTok’s terms, policies, disclosure requirements, music rights, and advertising rules.

ViraLab AI is not endorsed by or affiliated with TikTok, Google, Stripe, Supabase, Vercel, Trigger.dev, fal.ai, or underlying model providers. Third-party services may change, reject, moderate, delay, or remove content independently of ViraLab AI.

9. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability, generation time, provider capacity, or permanent storage. You should download and back up important outputs. We may update, limit, suspend, or discontinue features for maintenance, safety, legal, provider, or business reasons.

10. Suspension and termination

You may stop using the service at any time. We may restrict or terminate access for a material breach, security risk, unlawful activity, non-payment, provider requirement, or conduct that threatens users or the service. Provisions concerning ownership, payment, disclaimers, liability, and disputes survive termination where applicable.

11. Disclaimers

To the extent permitted by law, the service and outputs are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these terms excludes rights or warranties that cannot legally be excluded.

12. Limitation of liability

To the extent permitted by law, ViraLab AI is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for losses arising from content you publish, third-party services, provider moderation, lost data, or unauthorised use outside our reasonable control. Our aggregate liability relating to the service will not exceed the amount you paid to ViraLab AI during the six months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.

13. Changes to these terms

We may update these terms to reflect service, provider, safety, or legal changes. The date above identifies the latest version. Continued use after an updated version takes effect constitutes acceptance where permitted by law.
